What Are My Rights as an Investor?

Making any sort of investment is a decision that shouldn’t be taken lightly.

Whether you’re financial planning after divorce, financial planning during the pandemic, or anything in between, it’s of the highest importance that you take the time to understand your rights and protect your investments.

Right to Quality of Service

As an investor, you have the right to be treated in a fair, ethical, and respectful manner. You should choose a financial advisor who agrees that they owe you a fiduciary duty – that they are obligated to make investment decisions and recommendations that are in your best interest and not their own. All fees, comparative risks, benefits, and costs must be disclosed to you before a contractual agreement.

Right to Change Advisor for Any Reason

Not only do you have the right to choose any financial advisor that you like, but you also have the right to change your financial advisor at any time, especially if you feel that the advisor has breached their duty in some way.

Right to Accurate and Transparent Reporting

You have the right to accurate and clear descriptions of all your transactions, statements, and communications. Furthermore, all costs, fees, and commissions must also be reported and disclosed to the investor.

Right to Prompt, Fair Resolution of Problems

If a problem or concern arises, you have the right to have the issue addressed promptly and by the compliance or legal department of the financial advisor. All relevant facts and circumstances should be considered in rendering a decision. If the decision is not to your satisfaction, investigate whether the financial advisor provides an opportunity to mediate or arbitrate the dispute.

Right to Access Account Information at Anytime

You have the right to request any information regarding the activity and balances of your account. Beware of investment scammers that are well-versed in ways of finding you but make it difficult or impossible for you to gain access to your money or information about it.

Have you been burned by a deceptive or incompetent financial advisor? You may have grounds to pursue a claim to recover your investment losses.
