Craig Frankel Speaks at Heckerling Institute on Estate Planning 2023

Founding Partner at Gaslowitz Frankel LLC, Craig Frankel, spoke at the 57th Annual Heckerling Institute on Estate Planning earlier this month. This virtual and in-person event brought industry professionals together for the nation’s premier continuing education program in estate planning. The event covered advanced-level topics in estate planning including litigation, international planning, philanthropy, ethics, and more.

Craig Frankel’s presentation, titled “You’re No Good, You’re No Good, You’re No Good, Baby, You’re No Good” – Saying Goodbye to the Recalcitrant Trustee, discussed how a beneficiary can force the removal of a recalcitrant corporate or individual trustee and whether the Uniform Trust Code could be of help in that endeavor. Frankel spoke on looking to the trust instrument itself for provisions to remove a trustee and, if the instrument does not permit no-fault removal, options to consider. Such options include non-judicial settlement agreements, trust modification by consent or based on unanticipated circumstances, removal due to lack of cooperation by co-trustees, failure of the trustee to administer the trust effectively, due to substantial change of circumstances, or for cause.

Craig Frankel is a frequent national speaker at continuing legal education programs, wealth management programs, and estate and tax programs, where he presents on fiduciary duties and the risks for fiduciaries. He was honored for the opportunity to speak at the Heckerling Institute, and anticipates continuing speaking engagements with Heckerling and other state-level and national events.
