Article Penned by LeAnne Gilbert Featured in The Mortmain

An article penned by Gaslowitz Frankel attorney LeAnne Gilbert was featured in the March publication of the Mortmain, a journal shared in the official Atlanta Bar Newsletter. The Atlanta Bar Association, the largest voluntary bar association in the southeast, has over six thousand members throughout metro Atlanta.

Ms. Gilbert’s article, “Duncan v. Rawls — S.E.2d — March 16th 2018: What Happened,” analyzes a recent ruling by the Georgia Court of Appeals regarding a trust dispute and the precedent their ruling sets by claiming that “the legislature, not the courts, are empowered by the Constitution to decide public policy.” The case will be brought before the Supreme Court of Georgia in August, which Ms. Gilbert says is “giving practitioners hope for additional guidance on these issues.”

This is not the first time Ms. Gilbert has been published by the Atlanta Bar Association. In June 2008, her article entitled “Survival of the Lucid Interval Doctrine After Mosely v. Warnock,” was published in the Atlanta Bar Association’s legal journal The Mortmain. She has also served as Editor-in-Chief of the University of Toledo Law Review.

Ms. Gilbert is well versed in fiduciary law and since joining Gaslowitz Frankel in 2006, has handled a variety of trust disputes, serving both plaintiffs and defendants. She recently acted as counsel, along with Craig Frankel, on a Georgia Supreme Court case regarding trusts. Her experience in trust disputes has given her substantial qualification to discuss such issues regarding trusts and court rulings.
