Common Types of Business Disputes

No matter how well a business is operated, most companies will have to address a legal dispute at some point.  Even with comprehensive agreements in place, disputes can arise. Here are a few of the most common types of business disputes.

Types of Business Disputes

  • Partnership Disputes: Disagreements among partners are common and partnership agreements rarely plan for every contingency.  Partnership disputes can involve disagreements about compensation, business strategy, succession planning, or any number of other issues.
  • Business to Business Disputes: Disputes between companies are as varied as disputes between people.  They include breach of contract claims, trademark claims and disputes arising between parties to a joint venture.
  • Breach of Non-Compete Agreements: Non-compete agreements between companies and their former employees often become the subject of litigation.  It is not uncommon for these agreements to be more restrictive than permitted under the relevant state’s law.  In addition, employees are not always clear on what is a breach of the agreement, particularly when it comes to approaching customers the employee came to know while working for their former employer.

Business disputes can often be resolved through arbitration or mediation.
